Olson Real Estate Group Inc. and 115 Schnebly LLC filed suit in Yavapai County Superior Court on Thursday, July 25, against 15 defendants, including the city of Sedona.
Sedona Mayor Scott Jablow, Vice Mayor Holli Ploog, Councilwoman Melissa Dunn, Councilman Brian Fultz, Councilman Pete Furman, Councilwoman Kathy Kinsella and Councilwoman Jessica Williamson are all listed as defendants individually.
The legal entity 115 Schnebly LLC is wholly owned by RD Olson Investments II LLC. The RD Olson group plans to build the Oak Creek Heritage Lodge at 115 Schnebly Hill Road, who development review was unanimously approved by the city of Sedona’s Planning & Zoning Commission on April 16.
By a 4-3 vote on June 25, in which Fultz, Dunn, Ploog and Jablow were in the majority, the Sedona City Council overturned and revoked the P&Z Commission’s unanimous approval of the development review.
Carol Breen, Nancy Friedman, Sean Smith, Mark TenBroek, Ann Kelley, Lauren Thomas, Christine Wagner, who filed two appeals against the proposed development, are also listed* as defendants in the lawsuit.
As of press time, Yavapai County Superior Court has issued summons for the defendants.
