Prosecutors want lawsuits against Ray disclosed1 min read

Prosecutors seeking a conviction in a manslaughter trial of motivational speaker James Arthur Ray want the defense to disclose civil lawsuits that have been filed against Ray after an October 2009 sweat lodge incident that left three people dead.

The move comes after the defense used a civil complaint against Ray filed by Laurie Gennari, a participant in the sweat lodge ceremony.

According to a motion filed last week, the prosecution was unaware of the lawsuit or the defense’s intention to use its existence to further their case during trial.

The state argues that since the defense is going to be introducing lawsuits during testimony, the state should have access to information about these lawsuits.

The prosecution argues that having to track down this information on its own would create an “undue hardship.”

The motion, filed by Yavapai County Attorney Sheila Polk, goes on to argue that disclosure of such lawsuits doesn’t violate Ray’s constitutionally protected Fifth Amendment right, citing other court rulings that dealt with similar issues.
